Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the DiceCue: Phone Dice app for iPhone and iPad, including its widgets, Control Center controls, and Shortcuts actions ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms.

Your license to use DiceCue

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App;
• Get around the App's purchase;
• Remove proprietary notices, or use our name, logo, or app icon without permission.

We retain all rights in the App, including its design, artwork, sounds, and trademarks.

Random rolls, for play

The App rolls dice with your device's system random number generator, so every face has the same chance on every roll, and no result is weighted or chosen in advance. The "this session" chart shows how often each number came up, so you can see this for yourself. Over a short session, some numbers will come up more than others. That's chance, not a fault.

The App is made for games and entertainment. It is not designed or certified for gambling, betting, lotteries, prize draws, or any game played for money, and you must not use it for those. You are responsible for following the rules of any game you play with it and the laws where you live.

Dice Sets

Every dice type, typed rolls such as 1d20+5, locking dice, shake to roll, the session chart, the table colours, and the widget and control that roll your table's dice are free to use, with no time limit and no ads. Dice Sets is an optional, one-time, non-consumable in-app purchase, with no subscription. It lets you save and name rolls, put them in groups and roll a whole group at once, add ready-made board game and tabletop RPG sets, and put a saved roll on a widget or a Control Center or Lock Screen control. We won't take away anything that was free.

The price is shown in the App and on the App Store before you buy, and Apple charges it to your Apple Account. Dice Sets works on devices signed in to the same Apple Account, and with members of your Family Sharing group if purchase sharing is on. If it doesn't show as unlocked, use Restore purchase in the App's Settings.

Your saved Dice Sets are stored only on the device where you made them. They don't sync between devices and aren't backed up by us, so keep your device backed up if you want to keep them.

All purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. If a purchase is refunded, Dice Sets locks again, and widgets and controls set to a saved roll say so instead of rolling.

Game names

The App's ready-made sets are named after the dice rolls used in well-known games, such as Catan, Yahtzee, and Risk, so you can find them. Those names are trademarks of their owners. DiceCue isn't affiliated with, endorsed by, or sponsored by them, and it doesn't include their games or rules.

Acceptable use

Use the App lawfully, and don't interfere with its operation or security. Be careful with shake to roll: hold your device securely, and don't shake it near people, breakable things, or while driving. You can turn shake to roll off in the App's Settings.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App will be uninterrupted or error-free, or that widgets and controls will be available on every device or iOS version.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of your use of the App. This includes losses relating to:

• The outcome of any game, bet, or decision made with a roll;
• Saved Dice Sets lost when a device is lost, erased, or replaced without a backup;
• A dropped or damaged device, or other harm, while shaking it to roll.

Our total liability for any claim relating to the App is limited to the greater of any amount you paid for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence where that rule applies.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
