Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the Jigovia: Jigsaw Puzzles app ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms. If you're under the age of majority where you live, a parent or guardian should review these terms with you and is responsible for any purchases you make.

Your license to use Jigovia

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App, or bypass the purchase required to unlock Jigovia Plus;
• Scrape, bulk-download, or redistribute the App's picture library, or access our picture server other than through the App;
• Remove proprietary notices, or use our name, logo, or app icon without permission.

We retain all rights in the App, including its design, puzzle artwork we created, curation of the picture library, and trademarks.

Jigovia Plus purchase

Jigovia is free to download and play. The free version includes a starter set of pictures, the daily puzzle, puzzles made from your own photos, puzzles of up to 64 pieces, a limited number of hints per puzzle, and a selection of board backgrounds.

An optional Jigovia Plus upgrade unlocks every picture in the library, puzzles of up to 324 pieces, unlimited hints, and every board background. The price is shown in the App before you buy and may differ by region.

• Jigovia Plus is a one-time, non-consumable purchase. It is not a subscription and does not renew.
• Payment is charged to your Apple Account when you confirm the purchase.
• Jigovia Plus supports Family Sharing, so members of your Family Sharing group can use it on their own devices if you have Family Sharing for purchases turned on.
• Your purchase is tied to your Apple Account. Use Restore Purchase in the App to unlock it on another device or after reinstalling.
• A puzzle you've already started can always be finished, even if Jigovia Plus is later refunded.

All purchases are processed by Apple, and refunds are handled by Apple under the App Store Terms of Service, not by us. We may add, change, or reorganize features over time, but we won't remove the core features of Jigovia Plus from people who have already bought it without good reason, such as a legal or technical requirement.

Puzzle pictures

The picture library is made up of public-domain works from museums, government agencies, and photo archives, along with original images made for Jigovia, some of them created with AI tools. The pictures are provided for playing puzzles in the App. These terms don't give you any rights in them beyond that, and some may be subject to the rights of third parties.

We add new pictures regularly and aim to publish a new daily puzzle every day, but we don't guarantee any particular number of pictures or schedule. We may remove, replace, or retitle pictures at any time, for example to correct a licensing or content problem. Picture titles and categories are provided for enjoyment and may not be complete or accurate.

If you believe a picture in the App infringes your rights, email us at [email protected] with details, and we'll review it promptly.

Your photos

When you turn your own photo into a puzzle, it stays on your device and in your private iCloud storage. We don't receive it and claim no rights in it. Only use photos you own or have permission to use, and don't use the App with content that is illegal or that violates anyone else's rights.

Your progress and data

Your puzzles in progress, history, and photo puzzles are stored on your device and, if you use iCloud, in your private iCloud storage. We don't have a copy and can't recover it for you. Losing your device, deleting the App, turning off iCloud, iCloud problems, or sync conflicts can cause progress to be lost or out of date. Pictures that haven't been downloaded yet need an internet connection.

Acceptable use

Use the App lawfully. Don't use it to interfere with the App's security, its purchase system, or our picture server, for example by sending automated or excessive requests.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App or the picture library will be uninterrupted, error-free, or available offline, that daily puzzles or reminders will arrive on time or at all, or that progress will sync or be preserved.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of your use of the App. This includes loss of puzzle progress or history from device failure, deletion, or iCloud sync problems, and pictures that are unavailable or have been removed.

Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
