Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the LevelCue: Level Tool & Angle app and its Control Center and Action button control ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms.

Your license to use LevelCue

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service. You may use it in your own work, including work you do for an employer or a customer.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App;
• Get around the App's purchase or free-try limits;
• Remove proprietary notices, or use our name, logo, or app icon without permission.

We retain all rights in the App, including its design, content, and trademarks.

A handy level, not a certified instrument

The App reads your iPhone's motion sensors and, for the protractor and plumb line, its camera. Its readings are estimates, and their accuracy depends on things we don't control:

• Your iPhone's sensors, which vary between devices and can drift over time;
• Your case and camera bump, which tip the phone. Calibrate the App, and calibrate again when you change your case;
• The surface or edge the phone rests on, and whether it's held still;
• For camera readings, where you place the guides, the camera angle, and lens distortion.

The App is not a certified, calibrated, or professional measuring instrument, and it isn't a substitute for one. Where a measurement affects safety, structure, drainage, code compliance, or the cost of materials, as in framing, decks, roofs, ramps, plumbing, concrete, or mounting heavy objects, check it with a proper level or instrument and follow the applicable building codes, manufacturer instructions, and professional advice. Take care when working at height, such as on ladders or roofs.

You are responsible for how you use the App's readings and for any work you do based on them.

Leveling an RV safely

RV mode shows which wheel is low and, with LevelCue Pro, an estimate of how far to raise each wheel, worked out from the angle and the RV size you enter. The estimate is only as good as the reading and the dimensions, and it doesn't account for your suspension, tires, ground conditions, or leveling equipment.

Before leveling, chock the wheels, set the parking brake, and follow your RV, trailer, and leveling equipment manufacturers' instructions. Use leveling blocks, ramps, and jacks within their rated capacity, on firm ground. Never get under a vehicle supported only by jacks or blocks. The App doesn't check that a vehicle is stable or safe.

LevelCue Pro

The level is free to use with no time limit. LevelCue Pro is an optional, one-time, non-consumable in-app purchase, with no subscription. It unlocks the camera protractor and plumb line, the inches to raise each wheel in RV mode, and unlimited saved readings. Without Pro, the App keeps your three most recent saved readings.

The price is shown on the App Store before you buy, and Apple charges it to your Apple Account. Pro works on devices signed in to the same Apple Account, and with members of your Family Sharing group if purchase sharing is on. If it doesn't show as unlocked, use Restore purchase in the App's Settings.

You may try the camera tools and the RV wheel inches once each for free on a device. A free try is a preview, not a license to those features.

All purchases are processed by Apple, and refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.

Acceptable use

Use the App lawfully, and don't interfere with its operation or security. Don't use the camera to view or measure people or places in a way that invades anyone's privacy.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App will be uninterrupted or error-free, that its readings will be accurate on every device, or that it will work with every case or accessory.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of your use of the App. This includes damage, injury, or loss relating to:

• Work, installations, or purchases made on the strength of a reading;
• Leveling, raising, or parking a vehicle, RV, or trailer;
• Falls or accidents while measuring, including on ladders or roofs;
• Incorrect readings caused by your device, its case, its calibration, or how it was placed or held.

Our total liability for any claim relating to the App is limited to the greater of any amount you paid for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence where that rule applies.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
