Acceptance of these terms

These Terms of Use are an agreement between you and Buknal Enterprise LLC ("we," "us") covering the PawTono: Dog Whistle & Clicker app for iPhone, iPad, and Apple Watch, including its widgets and controls ("the App"). By downloading or using the App, you accept these terms and Apple's Licensed Application End User License Agreement (the "Apple EULA"). If you don't agree, don't use the App.

Our Privacy Policy explains how information is handled and forms part of these terms. If you're under the age of majority where you live, a parent or guardian should review these terms with you and is responsible for any purchases you make.

Your license to use PawTono

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store Terms of Service.

You may not:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or attempt to extract its source code;
• Sell, rent, sublicense, or redistribute the App, or bypass the purchase required to unlock PawTono Pro;
• Copy or redistribute the App's training lessons, sounds, or illustrations outside the App;
• Remove proprietary notices, or use our name, logo, or app icon without permission.

We retain all rights in the App, including its design, sounds, illustrations, training content, and trademarks.

PawTono Pro purchase

PawTono is free to download. The free version includes the whistle, the clicker sounds, the training guide, widgets, the Control Center control, Siri and Shortcuts actions, the Apple Watch remote, iCloud sync, one dog, and up to three training sessions a week.

An optional PawTono Pro upgrade unlocks unlimited training sessions and full history, more than one dog, skill plans, streaks and reward-rate stats, and recording your own cues. The price is shown in the App before you buy and may differ by region.

• PawTono Pro is a one-time, non-consumable purchase. It is not a subscription and does not renew.
• Payment is charged to your Apple Account when you confirm the purchase.
• PawTono Pro supports Family Sharing, so members of your Family Sharing group can use it on their own devices if you have Family Sharing for purchases turned on.
• Your purchase is tied to your Apple Account. Use Restore Purchase in the App to unlock it on another device or after reinstalling.
• Training sessions and dogs you've already saved stay in your log, even if PawTono Pro is later refunded.

All purchases are processed by Apple, and refunds are handled by Apple under the App Store Terms of Service, not by us. We may add, change, or reorganize features over time, but we won't remove the core features of PawTono Pro from people who have already bought it without good reason, such as a legal or technical requirement.

Training guidance

The App's lessons, skill plans, goals, and tips describe common reward-based training methods and are provided for general information only. They are not professional training, behavioral, or veterinary advice, and they can't account for your dog's age, health, temperament, or history. Results vary from dog to dog, and we don't promise that any dog will learn a particular behavior.

You are responsible for your dog's safety and behavior while training, including in public places and around other people and animals. If your dog shows aggression, fear, pain, or sudden changes in behavior, stop and consult a veterinarian or a qualified trainer or behaviorist.

Sound, hearing, and your dog's welfare

The whistle plays high-frequency tones through your device's speaker. Phone and tablet speakers can play sounds up to about 20 kHz, so the whistle is not silent or ultrasonic: many people, especially children and younger adults, can hear it, and some find high pitches unpleasant.

• Start at a low volume and raise it gradually. Don't hold the device close to your own, another person's, or an animal's ears.
• Stop if your dog or any other animal or person seems distressed, and don't use the App to startle, punish, or harass an animal or person.
• PawTono is a training tool. It is not designed to stop barking or to repel animals, and we make no claim that it will.
• Sound output depends on your device, its speaker, case, and volume settings. We don't guarantee that any particular frequency will play accurately or be heard by your dog.

Your photos and recordings

Photos you add of your dog and cues you record stay on your devices, and photos also in your private iCloud storage. We don't receive them and claim no rights in them. Only use photos you own or have permission to use, and only record voices with the speaker's permission.

Your training data

Your dogs and training sessions are stored on your device and, if you use iCloud, in your private iCloud storage. Recorded cues stay on the iPhone that made them. We don't have a copy and can't recover any of it for you. Losing your device, deleting the App, turning off iCloud, iCloud problems, or sync conflicts can cause data to be lost or out of date. The Apple Watch remote needs a paired iPhone nearby, because the iPhone plays the sounds and saves your sessions.

Acceptable use

Use the App lawfully and considerately. Don't use it to cause a nuisance, to harass or distress people or animals, or to interfere with the App's security or its purchase system.

Third-party fonts

The App uses these typefaces, each licensed under the SIL Open Font License, Version 1.1:

• Archivo, Copyright 2020 The Archivo Project Authors;
• Figtree, Copyright 2022 The Figtree Project Authors;
• DM Mono, Copyright 2020 The DM Mono Project Authors.

The full license text for each font ships with the App. These terms don't change the rights the Open Font License gives you in those fonts.

Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don't warrant that the App will be uninterrupted or error-free, that it will produce any training result, that reminders will arrive on time or at all, that the Apple Watch remote will stay connected, or that your data will sync or be preserved.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Buknal Enterprise LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of your use of the App. This includes loss of training history or recordings from device failure, deletion, or iCloud sync problems, and any injury, illness, behavior, or hearing discomfort involving a person or animal that results from following the App's guidance or using its sounds.

Our total liability for any claim relating to the App is limited to the greater of the amount you paid us for it in the 12 months before the claim, or $50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Apple's role

This agreement is between you and us, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.

We, not Apple, are responsible for addressing any claim that the App or your use of it infringes intellectual property rights, and for product liability claims, claims that the App fails to conform to legal requirements, and claims under consumer protection or similar laws, to the extent the law allows. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

Termination

You may stop using the App at any time by deleting it. We may suspend or terminate your license if you breach these terms. Sections that by their nature should survive termination, including the disclaimers, limitation of liability, and governing law, survive it.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction. If you are a consumer elsewhere, this doesn't deprive you of the protections of the mandatory laws of your country of residence.

If any provision of these terms is found unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms as the App changes. The updated version takes effect when posted on this page, with a revised "Last updated" date. Continuing to use the App after a change means you accept the new terms.
